The people at CHEATERS® are very sensitive to privacy issues. We respect your right to privacy and feel it is important for you to know how we handle the information we receive from you through our website at (the “Site”), affiliated web addresses, email communications, mail and deliveries to our business offices, and phone calls and facsimiles, whether solicited or unsolicited, and have prepared this Privacy Policy to answer your questions regarding our privacy practices and principles.

When this Privacy Policy (“Policy”) uses the term Personally Identifiable Information (“PII”), we are referring to information that identifies a particular individual, such as the individual’s name, postal address, email address, telephone number, and other numbers or designations that identify licenses or accounts held by an individual. When other information, such as, by way of example only, employment status, marriage and family statistics, social or political ideology, business habits or practices, and consumer product preferences, is directly associated with PII, this other information also becomes PII for purposes of this Policy.

Scope of This Policy

This Policy applies to all PII that we collect, on or after the effective date of this Policy, from individuals who provide us such information for the purpose of (1) participating in our interactive Site, (2) uploading User Content, (3) obtaining from us or our advertisers a product or service, (4) accessing the Site’s blogs, discussion forums, surveys and interactive voting, message boards, bulletin boards, chat rooms and links, (5) emailing questions or other consumer communications to CHEATERS®, (6) other legitimate use of an online user account, and (7) written or oral communications with CHEATERS® regarding any of these or other matters. This Policy also applies to all PII that CHEATERS® obtains from its parent corporation and any affiliates and subsidiaries on or after the effective date of this Policy.

Information We Collect

We may collect various types of PII. For example, we may receive PII directly from Site users for the purposes outlined above. This information may include the Site user’s name, postal address, email address and telephone number. We also may collect other types of information such as gender, age, number of children and personal interests, which we may associate with PII. For example, if you provide opinion in connection with our programming, you may reveal, and it may become a part of your PII, certain social or political beliefs. Further, if you purchase a product or service through the Site, we may obtain credit card information, learn your product preferences, and more. In addition, we may collect PII from you if you participate in sweepstakes, contests, games and promotional offers.

PII From Children Under 13

Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) over the Internet to us or to anyone else. We won’t knowingly allow anyone under 13 to register with our Site or to provide any other PII through the Site. If you are under 13, please do not provide us with any PII about yourself.

Protecting Your PII

We have taken precautionary measures to make all information received from our Site users and other customer communications as secure as possible against unauthorized access and use. First, CHEATERS® employees, agents and contractors must have a legitimate business reason to obtain access to your PII. Second, we do not sell or share your PII to companies outside of our affiliated companies except as specifically disclosed in this Policy or as disclosed in updates of this Policy or similar communications.

However, it may be necessary for us to provide your information to contracted third party partners in order to respond to your inquiries and to provide you with products and services. But even in those instances, such third party partners may only use the information provided for the specified use and purpose.

Moreover, we have appropriate security measures in place to protect against the loss, misuse or alteration of information that we have collected from you. CHEATERS® uses reasonable administrative, technical, personnel and physical measures to safeguard PII in its possession against loss, theft and unauthorized use, disclosure or modification. In addition, CHEATERS® uses reasonable methods to make sure that PII is accurate, up-to-date and appropriately complete. Passwords and other sensitive information stored by CHEATERS® are encrypted both in transit and when stored within CHEATERS®’ online databases.

How We Use and Share the PII That We Collect

We may use and share your PII collected under this Privacy Policy in a variety of ways, including, for example:

  • We may send you promotional materials, and we may share your PII with our parent corporation and any affiliates or subsidiaries and third party partners so that they can send you promotional materials. (By “promotional materials,”; we mean communications that directly promote the purchase of products or services.) These promotional materials may concern our products and services, or the products and services of CHEATERS® or another affiliate of CHEATERS® or a third party partner. These promotional materials may be sent to you by postal mail, email or other means.
  • We may use your information to complete transactions requested by you, or to send you administrative communications about any account you may have with us or about future changes to this Privacy Policy.
  • We may take your PII and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics (such as your name) that make the information personally identifiable to you (de-personalizing your information). We may use this non-PII for, among other purposes, research and analysis to improve our products and services.
  • We may hire companies to help deliver products or services, like a shipping company that delivers a package or a company that helps fulfill prizes for a sweepstakes. In those instances, there is a need to share your information with these companies. Sometimes we also may work with other companies who help either gather your information or communicate with you.
  • We may disclose PII when we believe in good faith that such disclosures (1) are required by law or (2) will help to (a) enforce contest, sweepstakes, promotions and game rules; (b) protect your safety or security, including the safety and security of property that belongs to you; and (c) protect the safety and security of CHEATERS®, our parent corporation and any affiliates or subsidiaries and third party partners, including the safety and security of property that belongs to them.
  • From time to time, we may offer you the opportunity to “opt-in” or “opt-out” of certain uses of your PII, or our sharing of your PII with our parent corporation and any affiliates or subsidiaries or third party partners.

What Kind of Information May We Obtain From Related Entities

We may obtain from our parent corporation and any affiliates and subsidiaries the same types of PII that we collect directly from our Site users.

How We Use and Share the PII That We Obtain From Related Entities

You may have provided PII to our parent corporation and any affiliates or subsidiaries through their affiliated web addresses or through email, mail or telephone communications. Our use and sharing of PII regarding you that we obtain from those related entities is subject to the Privacy and Security Policies in place for those entities and any choices you have made under the Privacy and Security Policies in place for those entities.

Email Communications

You should also know that unless otherwise noted, the email functionality on the Site does not provide a completely secure and confidential means of communication. It is possible that your email communication may be accessed or viewed inappropriately by another Internet user while in transit to us. If you wish to keep your information completely private, you should not use email.

We may send email communications to you related to your use of the Site, Site updates, communications regarding programming, Program Content, your or another user’s User Content, your user account, and other general matters.

Your Online Preferences

CHEATERS® uses “cookie” technology to obtain usage information from our Site users. Cookies are small bits of information that the Site place on the hard drive of your computer. Cookies remember information about your activities on our Site and enable CHEATERS® to make your visits to our Site more enjoyable. For example, cookies can store your password for easy logon to a site you have previously visited, can save your preferences for a personalized home page or can track the items you have placed in your “shopping cart” during a visit to our online store. Information about your activities on the Site and other non-PII about you may also be used to limit the online ads you encounter to those we believe are consistent with your interests.

Third party advertisements displayed on the Site may also contain cookies set by Internet advertising companies or advertisers. CHEATERS® does not control these advertiser cookies, so users of our Site should check the Privacy Policy of the Internet advertising company or advertiser to see whether and how it uses cookies.

CHEATERS® may use cookies and similar tools to relate your use of our Site to PII obtained from you or a reputable third party. For example, if you’ve asked us to provide you information about our upcoming programming, promotions, products or services, cookie and/or click-stream data about your activities on our Site may allow us to limit the materials we provide you to items we think you will find interesting, based on your prior online activities and preferences. However, if CHEATERS® wishes to combine your personal and cookie and click-stream information in this manner, we will obtain your express affirmative consent.

You can program your computer to warn you each time a cookie is being sent or to refuse cookies completely. You may even disable your cookie information by adjusting your browser preferences on your personal computer at any time. However, without cookies, you will not have access to certain features on the Site, such as interactive “polling” and video player settings.

The Site may be linked to Internet sites operated by other companies. Some of these third party sites may be co-branded with the CHEATERS® logo, even though they are not operated or maintained by CHEATERS®. The Site also carries advertisements from other companies. CHEATERS® is not responsible for the privacy practices of websites operated by third parties that are linked to our Site or for the privacy practices of third party or national Internet advertising companies. Once you’ve left the CHEATERS® Site via such a link or by clicking on an advertisement, you should check the applicable Privacy Policy of the third party or advertiser website to determine how they will handle any PII they collect from you.

Some of the advertisements that appear on the Site are delivered to you by national Internet advertising and application companies. These companies utilize certain technologies to deliver advertisements and marketing messages and to collect anonymous information about your visit to our Site, including information about the banner ads they display, any cookie they place on your computer and your IP address. CHEATERS® is not responsible for the privacy practices of these advertisers. You should check the applicable Privacy Policy of the advertiser to determine how they will handle any PII they collect from you.

Amendments to This Privacy Policy

We may amend this Policy at any time. If we amend this Policy to permit material changes in the way we collect, use and share your PII, we will notify you of such changes by prominently posting notice of the changes on the Site. Any such material changes to this Policy will be effective thirty (30) calendar days following our posting. Any such material changes to this Policy may affect our use and sharing of PII that you provided to us before our notification to you of the changes. If you do not wish to permit material changes in our collection, use or sharing of PII that you have provided to us before the effective date of such changes, you must so notify us before that effective date. Please be advised, however, that, regardless of whether you provide such notice to us, the changes to this Policy will apply to any PII that you provide to us on or after the effective date of such changes.
